Scoop Rental Terms of Service

1. Agreement to Terms

By reserving, renting, operating, or using any vehicle provided by Scoop Rental LLC (“Company,” “we,” “us,” or “our”), you (“Renter,” “you,” or “your”) agree to be bound by these Terms of Service (“Terms”). If you do not agree, do not use our services.

2. Eligibility Requirements

To rent a vehicle, you must:

●     Be at least 18 years old (or higher if required by law or insurer).

●     Hold a valid driver’s license issued by a recognized authority.

●     Provide proof of insurance if requested.

●     Present a valid payment method in your name.

●     Pass identity, driving history, and fraud prevention checks.

We reserve the right to deny rentals at our sole discretion.

3. Reservations & Availability

●     Reservations are requests only and are not guaranteed until confirmed.

●     Vehicle makes/models may vary based on availability.

●     We may substitute a similar class vehicle when necessary.

●     We may cancel reservations for suspected fraud, nonpayment, or operational reasons.

4. Rental Period

●     Rental begins at the scheduled pickup/delivery time and ends when the vehicle is returned and accepted by us.

●     Late returns may incur additional hourly or daily charges.

●     Unauthorized extensions are prohibited. Contact us before the scheduled return time to request an extension.

5. Payment Terms

You authorize us to charge your payment method for:

●     Rental fees

●     Security deposit

●     Mileage charges (if applicable)

●     Fuel charges

●     Tolls, tickets, parking fees

●     Cleaning fees

●     Damage, loss, theft, or diminished value

●     Late fees

●     Collection costs, including attorney fees where permitted by law

All charges are subject to applicable taxes and fees.

6. Security Deposit

A refundable security deposit may be required before the rental begins. We may retain all or part of the deposit for unpaid balances, damages, excessive cleaning, smoking, policy violations, or administrative costs.

7. Authorized Drivers

Only drivers approved by us and listed on the rental agreement may operate the vehicle. Unauthorized drivers are strictly prohibited and may void coverage or result in immediate termination of the rental.

8. Prohibited Uses

You may not use the vehicle for:

●     Illegal activity

●     Racing, drifting, towing, or off-roading

●     Transporting hazardous materials

●     Driver training

●     Carrying passengers for hire unless expressly authorized

●     Operating under the influence of alcohol or drugs

●     Reckless, negligent, or distracted driving

●     Subleasing or transferring possession

●     Crossing borders or leaving approved geographic areas without permission

Violation may result in repossession and additional charges.

9. Mileage Limits

If mileage limits apply, they will be disclosed at booking. Excess mileage will be billed at the posted rate.

10. Fuel Policy

Unless otherwise stated, vehicles must be returned with the same fuel level provided at pickup. Missing fuel will be charged at prevailing rates plus service fees.

11. Condition of Vehicle

You acknowledge the vehicle was received in acceptable condition unless noted at pickup. You agree to return it in substantially the same condition, excluding normal wear.

Please inspect the vehicle at pickup and report any pre-existing damage immediately.

12. Maintenance & Mechanical Issues

●     You must monitor warning lights, fluid levels, and tire condition during extended rentals.

●     Do not perform repairs without prior approval unless necessary for safety.

●     Notify us immediately of breakdowns or mechanical issues.

●     Reimbursement for authorized repairs requires receipts.

13. Accidents & Incidents

In the event of an accident, theft, vandalism, or damage, you must:

  1. Notify emergency services if needed

  2. Notify us immediately

  3. File a police report when applicable

  4. Exchange information with involved parties

  5. Cooperate fully with claims handling

Failure to report promptly may increase your liability.

14. Insurance & Liability

Unless otherwise provided in writing:

●     You are responsible for all damage, loss, theft, towing, impound, and related costs during the rental period.

●     Your personal auto policy or credit card coverage may provide protection, subject to their terms.

●     Optional protection products may be offered separately where lawful.

We do not guarantee that any third-party insurance will apply.

15. Traffic Violations, Tolls & Fees

You are responsible for all tolls, tickets, citations, impound fees, storage fees, and administrative processing charges incurred during the rental period.

16. Cleaning & Smoking Policy

Vehicles must be returned reasonably clean. Additional fees may apply for:

●     Excessive dirt, stains, pet hair, odors

●     Smoke or vaping residue

●     Biohazard cleanup

●     Trash removal

17. GPS, Cameras & Telematics

Vehicles may contain GPS, telematics, dash cameras, or tracking devices where lawful. We may use this data for fleet management, theft recovery, mileage verification, accident investigation, and safety monitoring.

18. Personal Property

We are not responsible for items left in the vehicle. Abandoned property may be disposed of after any legally required holding period.

19. Cancellation & Refunds

●     Cancellation policies may vary by booking channel.

●     No-shows may be charged.

●     Early returns do not guarantee refunds unless required by law or agreed in writing.

20. Repossession

We may remotely disable, recover, or repossess the vehicle without notice where lawful if the vehicle is overdue, abandoned, stolen, used unlawfully, or if these Terms are violated.

21. Indemnification

You agree to indemnify and hold harmless the Company, its owners, employees, and agents from claims, damages, losses, liabilities, and expenses arising from your rental or use of the vehicle.

22. Limitation of Liability

To the maximum extent permitted by law, we are not liable for indirect, incidental, special, or consequential damages including lost profits, missed work, travel disruption, or personal property loss.

23. Privacy

We may collect personal information necessary to operate the rental service, verify identity, process payments, manage risk, and comply with legal obligations. Please review our Privacy Policy.

24. Chargebacks & Disputes

If you initiate a chargeback for valid charges, we reserve the right to provide rental records, photos, telematics, communications, and agreements to the payment processor. Unsuccessful chargebacks may result in additional collection efforts.

25. Governing Law

These Terms are governed by the laws of the State of Minnesota, without regard to conflict of law principles.

26. Arbitration / Dispute Resolution

Any dispute arising from these Terms may be resolved through binding arbitration or small claims court where permitted by law. Each party waives the right to jury trial except where prohibited.

27. Severability

If any provision of these Terms is found unenforceable, the remaining provisions remain in effect.

28. Modifications

We may update these Terms at any time. Updated versions become effective when posted or provided to you.

29. Acceptance

By booking or using our vehicles, you confirm that you have read, understood, and agreed to these Terms of Service.
